Lander County District Court
Proceedings Austin Reveille, May 8, The May term
of the Third Judicial District Court convened
Wednesday with Judge Breen presiding. The morning
was devoted to the criminal calendar, arraignment
and setting dates for hearings. In the matter of
the State vs. Robert Hogan, charged with
misappropriating county funds as treasurer, when
the indictment was read, Mr. Hogan, who appeared
in court without counsel, stated that he did not
want counsel and that he did not want time in
which to answer, demur or otherwise plead to the
indictment.
The Court instructed the Clerk to enter a
plea of not guilty to each of these indictments.
Mr. Hogan raised the question of the competency of
Judge Breen to give him a fair trial, whereupon
the court, with the agreement of District Attorney
Maestretti, postponed the date of setting a day
for trial until Thursday, May 13. In the meantime,
the Court stated that other judges in the State
would be communicated with to find out when it
would be convenient for one of them to come to
Austin to try the cases. The District Attorney
also stated in the course of the proceedings that
he could not be ready to try the Hogan cases at
this term. Eureka Sentinel Saturday May
